Terms of Use

These Terms of Use (the “Terms”) govern your access to and use of The Evening Coach (“the Service”), an initiative of Talent Share Community Foundation. By creating an account, signing in, or submitting the contact form on the home page, you agree to these Terms. If you do not agree, please do not use the Service.
1. The service
The Evening Coach is a preventive psychology habit-building program. It provides daily check-ins, a personal journal, an inbox for coach messages, push notifications, and a one-on-one channel between you and your assigned coach. The service is delivered by the Talent Share Community Foundation as a non-profit activity, at cost price.
The Evening Coach is not medical or psychological treatment. It is an educational coaching program focused on prevention. If you are in a mental-health crisis or believe you need clinical care, please contact your doctor, a specialised care provider, or the relevant emergency line in your country.
2. Eligibility & accounts
- You must be at least 18 years old to create an account.
- Access is by invitation: an admin or your assigned coach creates your account and shares a temporary password.
- You are responsible for keeping your password confidential and for any activity under your account.
- We may suspend or terminate accounts that violate these Terms or applicable law.
3. Acceptable use
You agree not to:
- upload illegal, harmful, or infringing content;
- harass, threaten, or impersonate other users, coaches, or staff;
- attempt to access accounts, data, or systems you are not authorised to use;
- scrape, mirror, reverse-engineer, or otherwise misuse the Service;
- use the Service for any commercial purpose without our written consent.
4. Coach & admin roles
Coaches and admins can access content (journal entries, messages, settings) of users assigned to them, in order to deliver the coaching service. They are bound by confidentiality and data protection obligations described in our Privacy Policy.
5. Content ownership
You retain ownership of the content you create (journal entries, motivation answers, voice notes, questions, photos). By using the Service you grant us a limited, non-exclusive licence to host and process that content for the sole purpose of operating the coaching service. We never sell or share your content with third parties for marketing.
6. Coach replies and program content
Replies, messages, and program content created by coaches and the foundation belong to Talent Share Community Foundation. They are shared with you for personal, non-commercial use. You may not redistribute or publish them without permission.
7. Service availability
We aim for high availability but do not guarantee uninterrupted access. We may perform maintenance, change features, or shut down parts of the Service. Where reasonably possible we will give advance notice inside the app.
8. Notifications
We send push notifications only when you have enabled them on a device. Coaches and admins use them to deliver coaching messages, reminders, and occasional important announcements. You can disable notifications at any time from your device settings or from your account settings inside the app.
9. Disclaimer & liability
The Service is provided as is and as available. We do not warrant that the Service will meet your expectations, that it will be error-free, or that any specific result will be achieved. To the maximum extent permitted by Dutch law, our liability is limited to direct, demonstrable damages caused by gross negligence or wilful misconduct, capped at the amount you paid for the Service in the 12 months preceding the claim. For users on a free or cost-price plan that amount may be very low or zero.
10. Termination
You can ask your coach or admin to deactivate your account at any time. We may terminate or suspend access if you breach these Terms, with or without prior notice in cases of serious or repeated violations.
11. Changes to these Terms
We may update these Terms when the Service or applicable law changes. The “Last updated” date at the top reflects the most recent version. Significant changes will be announced inside the app, and continued use after the announcement counts as acceptance.
12. Governing law
These Terms are governed by the laws of the Netherlands. Any dispute that cannot be resolved amicably will be brought before the competent court in the district where the foundation is registered, unless mandatory law provides otherwise.
